Peluang BN di Mahkamah Persekutuan cerah!

Semalam Mahkamah Tinggi Kuala Lumpur telah memutuskan bahawa Menteri Besar Perak adalah sah milik Nizar dan permohonan untuk penggantungan bagi mengekalkan status quo sementara menunggu rayuanb di Mahkamah Persekutuan telah ditolak oleh Mahkamah.

Keputusan Mahkamah adalah berdasarkan kepada 2 sebab iaitu:-

1. Perlembagaan Perak tidak memperuntukkan Sultan memecat MB dan memandangkan Nizar enggan letak jawatan maka jawatan MB masih belum dikosongkan.

2. MB hanya boleh dipecat melalui undi tidak percaya di Dewan Undangan Negeri.

Walauapapun, secara tersirat, keputusan tersebut telah memberi satu nafas baru kepada persepsi sistem kehakiman kita yang mana menariknya kini, pembangkang bersungguh-sungguh bergantung kepada sistem yang dijajanya korup dan menyatakan bahawa keputusan tersebut adalah keputusan yang telus dan adil. Mereka kini meminta BN menerima keputusan tersebut.

Kalau dilihat daripada reaksi pemimpin BN, mereka tidak pula menyatakan bahawa keputusan tersebut tidak adil dan Hakim bertindak bias tetapi mereka menerima keputusan dengan hati terbuka dan meneruskan tindakan melalui proses undang-undang iaitu rayuan.

Menurut berita juga bahawa pejabat-pejabat MB dan exco-exco telahpun dikosongkan tanpa ada berlakunya huru hara. Juga, penyokong BN nampaknya terus bertindak bijak dengan tidak membuat apa-apa kekecohan.

Hal ini jelas berbeza dengan Pakatan Rakyat!! Terbaru kekecohan di persidangan Dewan Undang Negeri. Mereka yang menyerang, dikatanya mereka yang menjadi mangsa!!.

Walauapapun, berdasarkan fakta kes dan undang-undang yang telah dihujahkan oleh kedua-dua pihak, pada pendapat saya BN mempunyai kes yang kukuh untuk rayuan mereka dibenarkan di Mahkamah Persekutuan nanti.

p/s: Adakah PR boleh menerima kenyataan dan bersopan sekiranya Rayuan BN dibenarkan oleh Mahkamah Persekutuan atau boleh menutup mulut mereka daripada berkata Sistem Kehakiman kita adalah korup apabila keputusan tidak menyebelahi mereka??!! Jawapannya: Negatif!!

Apabila Nizar 'mendedahkan' perbincangannya dengan Sultan Perak!

Didalam perbicaraan kes penentuan yang mana Nizar mencabar Zambry sebagai MB Perak, terdapat satu Afidavit menarik yang difailkan oleh NIzar yang mana kononnya menceritakan apa yang berlaku semasa pertemuan di antara Nizar dan Sultan Perak.

Beliau menyatakan bahawa beliau tidak pernah memaklumkan kepada Sultan Perak bahawa beliau ingin membubarkan DUN kerana beliau tidak mendapat sokongan majoriti ADUN tetapi kononnya terdapatnya 'deadlock' didalam Dewan maka DUN hendaklah dibubarkan apabila 3 ADUN meletak jawatan!.

Cukuplah Nizar...cukuplah bermain kata-kata! Rakyat yang berfikiran terbuka tahu niat kenapa anda minta pembubaran, apatah lagi Sultan yang penuh ilmu didada...

Hal ini pernah dibincangkan didalam HUJAH di TV9 yang mana alasan utama NIzar minta pembubaran adalah sebenarnya disebabkan beliau hilang majoriti dan adalah didalam pengetahuan sesiapa pun bahawa kesemua 3 ADUN yang tersebut telah menyokong BN.

Malah, Nizar pernah ditanya berkenaan pembubaran DUN oleh pemberita semasa awal-awal lagi 3 Adun dikatakan meletak jawatan, takda pulak sibuk nak bubar!!

Mengapa perlu bermain kata-kata lagi? Kalau didalam prinsip undang-undang, terma 'reasonable man test' sekiranya ditanya, mereka akan menjawab Nizar minta pembubaran kerana NIZAR HILANG SOKONGAN MAJORITI!

APA lagi alasan anda Nizar??

WALAUAPAPUN, PERSOALAN PENTING DISINI adalah, kalau pun betullah itu yang difikirkan oleh Nizar, adakah pembubaran DUN seperti yang diminta NIzar menjadi relevan kini ketika mana Mahkamah Persekutuan telah memutuskan surat perletakan jawatan 3 ADUN tidak sah!!! Ia kini menjadi akademik, membuang masa, mencetus pelbagai polemik & menjadikan Institusi Raja sebagai bahan hinaan oleh segelintir masyarakat yang taksub membabi buta!!

Berikut adalah kata-kata NIzar kepada Sultan didalam Afidavitnya selepas Sultan enggan membubarkan DUN dan memintanya meletak jawatan! Patutla orang kata DERHAKA!!!

Hearing this, Nizar interjected and spoke for 15 minutes, urging the Ruler to allow the people of Perak to exercise their rights and elect their own government.

NIzar boleh sound Sultan Perak:- I pointed out that history showed that in countries such as Egypt and Iran the institution of the monarchy was diminished or completely wiped out when decisions not in the interest of people were made.''

Lanjut dialam The Malaysian Insider:-

KUALA LUMPUR, April 21 - He pleaded, appealed and even cajoled Sultan Azlan Shah to dissolve the Perak state assembly, saying that with the resignation of the three Pakatan Rakyat lawmakers there was deadlock in the House between the coalition he led and Barisan Nasional.

Datuk Seri Nizar Jamaluddin said that at no time during his audience with the Sultan did he ask the monarch to dissolve the assembly and call for fresh elections because he had lost the confidence of the majority of the members of the state assembly.

Nizar cleared this important point in an affidavit which was filed in the High Court yesterday as part of the judicial review application challenging Datuk Seri Zambry Kadir appointment as the Mentri Besar of Perak.
The Perak state legal advisor in his affidavit said that when Nizar appeared before the Sultan on February 4, he asked the Malay Ruler to dissolve the house because he had lost the confidence of the House.

This point is important because it gives some legitimacy to the Sultan's actions in asking Nizar to quit as the Mentri Besar, an act which paved the way for Zambry to be made the chief executive of the state.

But Nizar in his affidavit noted that the state legal advisor was an interested party in the case, having represented and taken instructions from Zambry.

His description of the events on Feb 4 were wrong, said Nizar. Nizar recalled that on Feb 4 he informed the Sultan that three Pakatan Rakyat lawmakers had resigned.

They could not be contacted and seemed to have gone missing.

He then asked the Sultan to dissolve the assembly because it was appropriate to have fresh elections given the deadlock situation in the House with Pakatan Rakyat and BN having equal number of seats.

The Sultan said he would study the matter further and told Nizar that Allah is with those who are patient.

At no point during the audience, did the issue of Nizar losing the confidence of majority of the assembly crop up.

On Feb 5, the Sultan informed Nizar that he was rejecting the request to dissolve the assembly.

Hearing this, Nizar interjected and spoke for 15 minutes, urging the Ruler to allow the people of Perak to exercise their rights and elect their own government.

"When the assembly is dissolved, the rakyat will view the Sultan as someone who is fair and not partisan. They will in turn respect the institution for returning to them their rights to elect the government.
This is also consistent with the constitutional monarchy system and democratic principle here…

"In contrast, if the people were denied their rights, the people may lose respect for the institution and the Sultan…I pointed out that history showed that in countries such as Egypt and Iran the institution of the monarchy was diminished or completely wiped out when decisions not in the interest of people were made.''

To support his case, Nizar also read out a passage from the book "Constitutional Monrachy: Rule of Law and Good Governance .

It said: "Under normal circumstances, it is taken for granted that the Yang di-Pertuan Agong would not withhold his consent to a request for dissolution of Parliament. His role is purely formal.

The book was given to Nizar by Sultan Azlan Shah when he was installed as the MB last year.

As soon as Nizar finished his 15 minute plea, the Sultan looked up at him and declared that he would not dissolve the assembly and urged Nizar to resign.

Meanwhile, in a supporting affidavit, Perak Speaker V Sivakumar said that on Feb 6, he wrote to the Sultan to convene a state assembly sitting so that a vote of confidence could be held.

Till today, he has not received a reply from the palace, forcing him to take steps to protect the name and integrity of the assembly.

DAP cursed the next Penang DCM 1!

DAP won’t stand for Zahrain standing in Penanti

PETALING JAYA, April 21 – The DAP has ruled out Penang PKR chief Datuk Zahrain Mohamed Hashim as a likely candidate for Penanti, saying he was “behaving like a little Umno leader” in criticising Lim Guan Eng.

The war of words between both Pakatan Rakyat allies is escalating despite discussions yesterday between the Penang chief minister and PKR de facto chief Datuk Seri Anwar Ibrahim.

“Such irresponsible comments by him would rule him out as the possible PKR and Pakatan Rakyat candidate for the Penanti by-election,” DAP publicity chief Tony Pua said in a media statement today.

PKR has said it will choose the Penanti candidate who if wins, will also be named as Penang deputy chief minister I.

Zahrain yesterday slammed the DAP secretary-general for being piqued over not being told of Mohammad Fairus Khairuddin’s resignation from the Penanti seat on April 16 although the letter was dated March 19.

“Datuk Zahrain’s baseless attacks against Lim are ill advised, irresponsible and politically motivated to help hide weaknesses in his leadership that caused so many problems in Penang PKR,” Pua added.

“It must also be emphasised that Guan Eng and the DAP has shown a genuine spirit of camaraderie and co-operation in the entire episode since Mohammad Fairus first resigned as the Deputy Chief Minister 1, despite having to withstand strong criticisms for the several postponements by Datuk Seri Anwar with regards to the naming of a replacement Deputy Chief Minister.”

Pua also disclosed that Anwar had not asked Lim to keep mum over the issue as advised by PKR deputy president Dr Syed Husin Ali yesterday.

“At no time did Datuk Seri Anwar say that Lim had no right to express his concerns when asked by the press. It would have been wiser and more rational for Dr Syed and Datuk Zahrain to check with Datuk Seri Anwar to understand what else more Datuk Seri Anwar had expressed to Lim,” he said.

Pua said Lim will not pursue the issue through the media but has the right to express disagreement with the national PKR leadership’s failure to inform Fairus’s resignation.

Tan Sri Alauddin Mohd Sheriff: Peribadinya disegani masyarakat Undang-undang!

Tan Sri Alaudin adalah sangat dikenali dikalangan masyarakat undang-undang termasuk peguam-peguam sebagai seorang hakim yang sangat dihormati peribadinya. Beliau juga merupakan Presiden Mahkamah Rayuan iaitu hirerki No. 2 didalam sistem kehakiman Negara. Beliau jugalah yang telah mempengerusikan panel 5 hakim Mahkamah Persekutuan yang mendengar kes-kes berkaitan krisis di Perak.

Secara peribadi, sepanjang hampir 10 tahun beramal sebagai pengamal undang-undang, kedengaran nama beliau begitu dihormati oleh kalangan peguam-peguam tidak kira latar belakang politik dan juga oleh rakan-rakan Hakim serta pegawai-pegawai undang-undang atas keputusan-keputusannya yang tidak berpihak atas mana-mana parti politik serta keputusan-keputusan adil yang berlandaskan undang-undang.

Maka, berdasarkan kepada itu, mengenali peribadi Tan Sri Alauddin sendiri, rakyat harus tahu bahawa keputusan secara sebulat suara tersebut (5-0) adalah keputusan yang jelas berlandaskan undang-undang tanpa ada pengaruh mana-mana kuasa politik. Sikap pembangkang yang cuba mengaitkan keputusan tersebut dengan pengaruh kuasa politik kerajaan adalah satu tindakan yang amat terdesak!!!.

KEPADA PEMBANGKANG:- JANGAN TIPU RAKYAT LAGI DENGAN PERMAINAN POLITIK TERDESAK.

Berikut adalah biodata Tan Sri:

Yang Ariff Tan Sri Alauddin Bin Dato' Mohd Sheriff telah dilahirkan di Kulim, Kedah pada tanggal 7 Ogos 1946. Beliau mendapat pendidikan awal di Sekolah Rendah Sungai Petani pada tahun 1953. Kemudiannya beliau meneruskan pengajiannya di Sekolah Rendah Bandar Baharu pada tahun 1955. Pada tahun 1959, Dato' Alauddin Mohd Sheriff menyambung pelajarannya ke Sekolah Menengah Sultan Badlishah sebelum bertukar ke Sekolah Menengah Ibrahim sehingga tahun 1963. Pada tahun 1964, beliau sekali lagi berpindah sekolah ke Kolej Sultan Abdul Hamid dan menamatkan zaman persekolahannya pada tahun 1965.

Dato' Alauddin telah meneruskan pelajarannya ke peringkat lebih tinggi apabila beliau menyambung pengajiannya ke Universiti Malaya pada tahun 1966. Pada tahun 1967, beliau telah berangkat ke London untuk menyambung pelajarannya dalam jurusan undang-undang di Inner Temple hingga tahun 1970.

Kerjaya :

* Pesuruhjaya Kehakiman di Johor Bharu (1992)
* Hakim Mahkamah Tinggi Kangar, Perlis (1994)
* Hakim Mahkamah Tinggi Alor Star, Kedah (1996)
* Hakim Mahkamah Rayuan Kuala Lumpur (2001)

Selama berkhidmat sebagai pengamal undang-undang, Yang Arif Dato' Alauddin telah dianugerahkan beberapa pingat kebesaran seperti Setia Mahkota Johor (S.M.J) pada tahun 1982, Pingat Ibrahim Sultan (P.I.S) pada tahun 1983, Darjah Paduka Mahkota Johor (D.P.M.J) pada tahun 1985 dan Dato' Setia DiRaja Kedah (D.S.D.K) pada tahun 1998 yang membawa gelaran Dato'.

Perak Crisis: The Reasons behind Federal Court's Decision

Below was quoted from The Star Online today, however it is not sufficient as my reference to analyze what was really transpired in the submissions and the judgment by the court.

Court: Sivakumar has no power to suspend Zambry, excos (Update 3)

PUTRAJAYA: The Federal Court ruled Thursday that Perak Assembly Speaker V. Sivakumar did not have the power to suspend Mentri Besar Datuk Dr Zambry Abd Kadir and his six executive council members from the assembly.

The Court then lifted the suspension on Dr Zambry and his six executive council members and said the seven could attend the next assembly sitting.

Court of Appeal president Justice Alauddin Mohd Sheriff who chaired a five-man panel Thursday said that it was a unanimous decision that the Speaker’s decision to suspend the seven applicants was ultra vires (outside the law) and invalid.

The other judges were Chief Judge of Malaya Justice Arifin Zakaria and Federal Court judges Justices Nik Hashim Nik Ab. Rahman, S. Augustine Paul and Zulkefli Ahmad Makinudin.

Justice Alauddin said the Bench would need to answer only two out of the six questions of law referred to the apex court for interpretation of Perak State Constitution and related law.

He said the answer was in the affirmative.

The two questions are whether, based on an interpretation of Article 44 of the Perak Constitution and all relevant laws, the Speaker’s decision to suspend the seven from attending the assembly was ultra vires and therefore, null and void.

Justice Alauddin said it is unnecessary to answer the remaining four questions.

The four questions covered, among others, whether charges against the seven was capable of constituting contempt against the assembly and whether the Speaker could call for an assembly of the House without a proclamation from the Ruler.

Justice Alauddin added that the Federal was exercising its power under Article 63 of the Perak Constitution to dispose the notice of motion at (Ipoh) High Court which is the originating summons.

The Bench did not order costs for any parties.

On Feb 18, Sivakumar, who headed the Committee of Special Privileges, suspended the seven and barred them from attending the assembly sittings for allegedly showing contempt for the House.

Dr Zambry was suspended for 18 months while his six excos were suspended for 12 months each.

Dr Zambry and the six had filed an originating summons at Ipoh High Court on March 2 seeking a declaration that the suspension order was illegal.

Outside the courtroom, lead counsel for the seven, Firoz Hussein Ahmad Jamaluddin said they were delighted with the ruling.

“The apex court has given us the declaration as per in the originating summons. As far as we are concerned, this means that all cases in Perak have been finally disposed off,” he said.

Firoz said the ruling also meant that it was up to the Sultan of Perak to summon the sitting of the assembly.

“It is a landmark case, as never in Malaysian history has there been a direct case as to the relation to the court and the legislature.

“The rule of law is essential. It is important to preserve both the state and Federal Constitution,” said Firoz.

Co-counsel for the seven, Datuk Mohd Hafarizam Harun said: “We want constitutional order to be restored in Perak. Finally, by May 9 or 10, depending on the Sultan’s consent, to have the House sitting,” he said.

Lead counsel for Sivakumar, Sulaiman Abdullah said he had yet to receive instructions from his client whether to file for a review of the court ruling.

“We want to look into next course of action. However, until (former Perak MB) Datuk Seri Mohammad Nizar Jamaluddin’s judicial review application (to challenge the validity of the apppointment of his successor) is not settled at the Kuala Lumpur High Court, this case is still on,” he said, adding that the defence team wanted to study the grounds of judgment when it was available.

Asked what would happen when an assembly was called, Sulaiman said, “It is up to the Speaker. It is another exciting thing to look forward to!”

Meanwhile, in Ipoh, Dr Zambry said that the notice calling for state assembly would be issued Friday or next week.

p/s: All these infos must be conveyed to the people immediately to ensure them not to be influenced by the opposition that the court is controlled by the government. Let people understand the reasons why the Federal Court had arrived to the decision.

Kaum cina: Jangan tegur?!

Nampaknya apabila DS Muhyiddin menyuarakan kebimbangan akan sikap orang-orang cina kerana tidak bersyukur, maka pemimpin-pemimpin kaum cina daripada pembangkang dan komponen BN sendiri mengkritik dan menghentam DS Muhyiddin.

Adakah persoalan dan kebimbangan ini hanya difikirkan oleh DSM semata-mata? Adakah persoalan ini tidak bermain-main dikotak pemikiran pemimpin-pemimpin kaum cina terutamanya dari komponen BN sendiri? SAya yakin hal ini juga disedari oleh pemimpin-pemimpin kaum cina sendiri.

Apabila DSM berterus terang dengan trend majoriti pengundi cina yang nampaknya tidak bersyukur, walaupun pelbagai imbuhan,tumpuan, keistimewaan dan pembaharuan dibawa oleh kerajaan BN dibawah pimpinan DS Najib sehingga meresahkan orang melayu yang menyokong BN sendiri, namun, trend majoriti kaum cina mengundi pembangkang walaupun menerima imbuhan-imbuhan tersebut amat membimbangkan!

Bukankah ini menimbulkan persoalan kepada sesiapa pun? bukan sahaja DSM tetapi kepada pemimpin-pemimpin termasuk kaum cina sendiri.

Adakah teguran ini tidak boleh dibuat oleh seorang pemimpin yang berkata atas suara hatinya dan majoriti rakyat yang menyokong BN berdasarkan suasana terkini? adakah kenyataan yang dilemparkan oleh DSM bohong dan tidak benar samasekali?

Sebenarnya yang tersirat, kenyataan DSM itu semata-mata ingin mengingatkan kaum cina untuk muhasabah segala kebajikan dan jasa kerajaan BN kepada mereka selama ini. Kekayaan dan penguasaan ekonomi daripada kaum cina sendiri adalah ketika kerajaan BN berkuasa!. Maka apa lagi yang anda inginkan??!

Juga, kini isu tersebut telah dimainkan oleh pembangkang terutamanya Lim Kit Siang kalau dilihat didalam laporan the malaysian insider yang terus meniupkan kebencian kaum cina kepada satu entiti melayu untuk keuntungan DAP.

Adakah kaum cina tidak boleh ditegur lansung?

p/s: Jangan laungkan kerajaan mesti menerima teguran tetapi mereka sendiri tidak boleh ditegur. Ke mana agaknya kuasa politik orang melayu bila bergantung kepada kaum lain sebagai kuasa penentu untuk berkuasa?

Melayu yang bunuh Melayu!

Kalau selama ini kita sering menyalahkan kaum-kaum lain akan keberanian mereka meminta-minta dan mengugut satu entiti yang selama ini mempunyai satu 'legititimate expectation' dengan berpegang teguh kepada janji kontrak sosial yang telah dipersetujui oleh semua kaum bagi menghargai umat melayu yang begitu bermurah hati kepada kaum-kaum lain di Tanah Melayu ini. Maka, adakah benar semata-mata mereka, menjadi mereka begitu 'tamak' untuk menuntut?

Maka; satu persoalan utama yang ingin dibangkitkan "apakah sebab utama yang membenarkan perkara ini berlaku?.

Jawapannya: tidak lain tidak bukan bangsa melayu sendiri yang membenarkan perkara ini berlaku.

Tidaklah ingin saya mengulas lanjut akan bagaimana saya katakan bangsa melayu juga yang menjadi 'duri dalam daging' & pengkhianat kerana saya percaya anda semua telah maklum akan isyarat fakta-fakta dan perkembangan politik tanahair terkini.

Itulah yang saya katakan sebagai isyarat telah jelas...namun samada kita masih bersikap 'marahkan nyamuk kelambu dibakar' ATAU kita kembali bersama menjaga kepentingan bersama kita tanpa mengira kekangan politik demi survival umat melayu (kita masih belum mampu bercerita kegemilangan orang melayu lagi), terpulanglah kepada anda sendiri untuk menilai.

Adakah kita umat melayu patut gembira keputusan PRK di Bukit Gantang? Bagi yang melihat kepada yang tersirat, PAS menang kerana undi kaum cina, agak-agaknya apakah yang menjadi perbualan dikalangan kaum cina pada masa ini ya? Mereka berjaya memperjuangkan hak kaum mereka, tapi kita? Apa lagi yang ada pada kita umat melayu selain daripada berpecah belah? Terpulanglah kepada anda untuk menilai!.

MAka benarlah kata Guru Hikam: " Mata kapak yang dibuat daripada besi tidak boleh memotong kayu, tetapi kayu juga yang boleh memotong kayu kerana mata kapak tanpa kayunya tidak boleh memotong."

Juga benarlah kata Guru Hikam, kalau ingin masuk politik kena ada 2 syarat: i) cukup iman dan ii)cukup duit. Dengan cukupnya 2 syarat ini, maka, mampulah dia menjaga diri daripada 3 'ta' iaitu "TAHTA, WANITA & HARTA".
